Nestled against the Snake River, Idaho Falls is an eastern Idaho tourist destination and major transportation hub. I-15 and US-20 bring many big trucks rumbling through our city, competing with smaller passenger vehicles for lane space. One unfortunate result of Idaho’s popularity is that our traffic-related deaths in 2023 are the highest they’ve been in 20 years.
If you were involved in an accident with a big rig, our Idaho Falls lawyers will help move your case forward with the personalization and attention it deserves. With more than a decade of service to Idahoans, we remain dedicated to helping injured people recover. Call us today or reach out online for your free case evaluation.

Damages You May Recover from a Truck Accident in Idaho Falls
Financial compensation can’t erase the losses you’ve suffered, but it can help you carve a new future for yourself. In Idaho Falls, you may pursue economic damages—losses with a measurable dollar amount attached, or noneconomic damages—losses that are subjective and without a specific monetary amount attached.
Economic Damages
- Medical care from the time of the accident to the present and expected care required in the future, including but not limited to ambulance, emergency room visits, surgery, treatment, prescriptions, medical devices and equipment, therapy, rehab, adaptations to the home or vehicle to accommodate current needs, transportation to and from medical appointments
- Out-of-pocket expenses such as copays, deductibles, assistance with chores and necessities of life that you may not be able to perform, for instance, childcare, errands, or home maintenance
- Loss of income during treatment and recovery, or change of income if your injury affects your ability to earn at your pre-accident level
- Loss of future earnings if your injury prevents you from resuming work
- Property replacement or repair, which would include your vehicle and any personal property damaged in the accident, such as your phone, personal belongings, or other property with you at the time of the crash
Noneconomic Damages
- Pain and suffering from the initial injury and throughout recovery, as well as long-term pain associated with some injuries
- Mental anguish, depression, PTSD, anxiety, or trauma that often lingers after a serious accident
- Loss of enjoyment of life
- Loss of quality of life
- Inconvenience and lifelong effects of a disability resulting from the crash
- Loss of consortium, meaning the loss of or change in the benefits and relationship between two people who are romantic partners and/or married
- Loss of or change in relationship with friends and family members
The types and amount of compensation you may recover after a truck accident in Idaho Falls will depend on the specifics of your case. Speak with our personal injury lawyers for a more precise explanation of what you may expect from a compensation settlement.

- Litigation—should your compensation claim be denied or the insurance company not negotiate in good faith, we will file a personal injury lawsuit and fight for your rights in court
Statute of Limitations to Begin Legal Action for Personal Injury From a Truck Collision
Idaho allows you two years from the date of the accident to begin legal action against the negligent or liable party. Two years can seem adequate, but negotiations for a compensation settlement from an insurance company should be resolved before legal action begins. This can take time.
It’s essential to work with your attorney to keep your case on track and moving forward. Should you miss the two-year deadline to file a personal injury lawsuit, you may be barred from seeking a compensation verdict from the courts.

Client Testimonials
We cannot share the hundreds of 5-star reviews we’ve received, but Ben H. reflects the mood of our clients when their cases come to an end:
“Thank you to the Sargent Injury Attorney team! Ryan handled my case with professionalism, efficiency, and was able to finish my case with a great result. From start to finish, the process was a breeze. His team gave great recommendations for medical treatment, and the process with insurance and the medical office was out of my hands and as hassle free as possible. I’m back on my feet, feeling great, and thankful to have a great resolution and healing from the injury I incurred.”
The Negligence Rule for Truck Accidents in Idaho Falls
Idaho follows the modified comparative negligence rule for truck collisions. This means that if you were partially to blame for the accident, you could recover damages if you were less than 50% at fault. If you were 50% or more at fault for the accident, you would not be allowed to recover compensation for your losses.
If you were not at fault for the accident and are awarded $100,000 in compensation, you will receive $100,000. If you are determined to be 30% at fault, you will receive $70,000 of your $100,000 compensation. If you are determined to be 50% at fault (or more), you will not receive any compensation.
Liable Parties for Truck Accidents in Idaho Falls
A truck driver’s negligent act may have caused the accident in which you were injured, but that doesn’t mean they are liable for the accident. They may not be the only liable party. If someone is liable for an accident, they are legally responsible and will most likely be the party we approach for a compensation settlement or judgment.
Liable parties in a truck accident may include:
- The truck driver
- The truck owner
- The trucker’s employer
- The truck manufacturer or the truck parts manufacturers
- The maintenance crew or company servicing the truck
- The cargo owner
- The cargo loaders
- The road maintenance crew or department
We cannot move forward with your compensation claim until we identify the liable party or parties in the investigative phase of your case. This is an area where our years of experience in personal injury claims play such a big role in allowing us to pursue a full and fair compensation claim.
