What About The State of Idaho’s Comparative Fault Law?
What if the business owner/individual or their insurance company asserts that you were partially at fault for the accident and contributed to your own injuries? Under current Idaho statutes, the law provides that in a negligent action, such as a slip and fall case, comparative fault indictable to the claimant diminishes proportionately the amount awarded as economic and noneconomic damages for an injury attributable to the claimant’s contributory fault, but the law does not bar recovery.
